European Private International Law

Course Description:
This course will analyze the rules of private international law (and international civil procedure) to be found in Europe; in particular, it will focus on those rules that are in force in most EU countries, thus allowing course participants to make a more informed decision as to where to start court proceedings when dealing with business partners from a EU country and, in doing so, to forum shop. In particular, the course will examine in depth the rules laid down in the 1980 Rome Convention on the law applicable to contractual obligations as well as those set forth in the Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters. In doing so, reference will be made to the case law of the European Court of Justice, where it exists
