About the Event
Dr Marie-Louise Holle’s presentation, Litigating in Tandem, examines the interaction between substantive obligations and injunctive relief in corporate climate accountability litigation. This structural tension, between an indeterminate substantive duty and the specificity required for an enforceable order, is not confined to civil law: common law systems face an analogous gap between substantive duty and enforceable relief. The presentation’s comparative analysis, however, draws on six cases from four European civil law jurisdictions, exploring how due diligence and tort-based duties interact with claims for preventive relief, and raising key questions regarding the duty of care, causation, imminence of harm, and the enforceability of mandatory orders.
