About the Workshop: This skills-based workshop provides a focused and practice-oriented exploration of representing individuals with mental disabilities in the criminal justice system. Drawing on extensive litigation experience and interdisciplinary engagement in the United States and beyond, the workshop outlines core principles of client-centered advocacy that account for the cognitive, psychological, and communicative dimensions of mental disability. It examines how defense counsel can identify and respond to mental health issues at every stage of a case, from initial client interaction through competency determinations, trial strategy, and sentencing. Emphasis is placed on adapting communication techniques, working effectively with experts, and navigating ethical complexities where client autonomy may be impaired or fluctuating. Through applied examples and targeted strategies, participants develop tools for constructing persuasive mitigation narratives and for advocating more effectively within structurally constrained systems. Particular attention is given to distinct populations, including individuals on the autism spectrum and those with dementia, highlighting the need for tailored and informed defense approaches.
About the Instructor: Elizabeth Kelley is a criminal defense lawyer in the United States with a nationwide practice focused on representing people with mental disabilities. She is the editor of Representing People with Mental Disabilities: A Practical Guide for Criminal Defense Lawyers (2018, 2024), Representing People on the Autism Spectrum: A Practical Guide for Criminal Defense Lawyers (2020), Representing People with Dementia, a Practical Guide for Criminal Defense Lawyers (2022), and Representing People with Trauma: A Practical Guide for Criminal Defense Lawyers (2026) – all published by The American Bar Association (ABA). Elizabeth serves as a Vice Chair of the ABA’s Criminal Justice Section Council and on the Editorial Board of Criminal Justice Section Magazine. She was named an ABA Fellow, and co-chaired the Criminal Justice Advisory Panel of The Arc’s National Center for Criminal Justice and Disability and the ABA’s Commission on Disability Rights. Elizabeth serves on the Advisory Board of The Neuroscience Center of Fordham University School of Law.
