Abstract:

It is an increasingly common refrain – China and the U.S. are heading toward, or already locked in, a new cold war. When powerful states see the existing international legal system as severely constraining their policymaking discretion, they tend to adjust the system to make it more compatible with their own interests and values. Therefore, it is unsurprising for the U.S. to declare that there are cracks in the foundations of international economic order developed after the Second World War and that it is essential for the U.S. to build an international economic system fit for contemporary geopolitical realities. This presentation seeks to explore the nascent features of international economic law in the era of great power rivalry, explain how such new features have disrupted the conventional understanding of international economic law, and speculate on their trajectory.
