Ratu Durotun Nafisah has published her commentary, “Excessive Reliance on Judicial Review in Indonesia: A Tactic to Avoid Democratic Accountability?” in the the Indonesian Journal of International and Comparative Law. The commentary argues that the presumptive legitimacy of the Indonesian Constitutional Court as an independent and reliable mechanism has been exploited by the legislature to evade its democratic accountability. This granted them legitimacy to avoid proper consultation with the public in the process of lawmaking and seemed to make them more resistant to dissent.
