Synopsis

As our economies become more sophisticated with cryptocurrency so have the means by which fraudsters operate. What action can be taken when the identity of the thief us unknown?

Join us for a lunchtime session with Oon & Bazul as we discuss a first-of-its-kind case in Singapore where we successfully secured one of the first ‘persons unknown’ injunctions in Singapore to freeze Bitcoin addresses containing stolen bitcoin. There will also be sharing of tips to become fraud and asset recovery practitioners and personal experiences in the fraud and asset recovery space.

About the Speakers

Abdul Malik – Partner

Head of Business Development

Malik is a Partner and Head of Business Development at Oon & Bazul. Malik is an Economics and Management graduate from Singapore and New Zealand. He also possesses a post graduate diploma in International Marketing from a leading Australian university.

Prior to his appointment at Oon & Bazul, Malik enjoyed a stellar management and business development career at organisations like Microsoft, CPA Australia, New Zealand Trade and Enterprise and the Energy Market Authority of Singapore, a statutory board of the Ministry of Trade and Industry.

He was also extensively involved in jurisdictions like Malaysia, Thailand, Indonesia and Hong Kong where he either had responsibility for the local team or spent a period of time living in these countries. In particular, he has a strong background in the energy sector, both upstream and downstream, having been a Senior Principal Analyst in the Industry Development arm of the Energy Market Authority where he worked on attracting leading energy organisations from around the world to test bed and commercialise their technologies in Singapore. Later as Director, he was responsible for the Singapore International Energy Week (SIEW), a gathering of 20,000 energy experts, 7 exhibitions/conferences and an energy summit which brought together energy ministers from ASEAN, Australia and New Zealand.

Presently, Malik manages a team of professionals who assist him in the financial, information technology, human resources, marketing and business development functions of the firm. One of his key responsibilities is ensuring that the firm recruits and retains the best talent in the legal industry. He also plays an active role in ensuring that clients’ needs are met in their interactions with the firm and remaining a one point of contact for clients who have multiple relationships in the firm. Malik is also responsible for the digitisation of the firm and ensuring that the latest technologies are evaluated and implemented for the firm. In his role as business development lead, he works with the Managing Partner to directly identify clients to target across a range of industries, develop and implement business development strategies and lead the engagement process. He is also actively involved in the resourcing of matters and ensuring that clients get the best lawyers possible to manage their matters.

Prakaash is a Partner in the Litigation & Dispute Resolution Practice.

Prakaash specialises in commercial litigation and arbitration with a focus on international commodity trade, trade finance, marine insurance and “dry” shipping work (including charterparty and bill of lading disputes).

Prakaash has substantial experience handling disputes involving misdelivery claims and also the knock-on indemnity claims under letters of indemnity which are issued for the delivery of cargo without presentation of the original bills of lading. He also has particular expertise handling trade finance disputes including letters of credit, bills of exchange and documents against acceptance transactions. He has advised trade financing banks based in Singapore and commodity trading houses on trade finance litigation, including the ICC DOCDEX dispute resolution procedure. Prakaash also regularly advises clients on sanctions related matters, including the impact of the US, EU and UN sanctions on businesses based in the region.

He regularly represents banks and financiers in multi-jurisdictional enforcements and also frequently acts for marine insurers (P&I, H&M and cargo) and for insurance claimants.

The international nature of his practice often necessitates taking account of legal issues and the court procedures of more than one jurisdiction. He not only regularly appears in the Singapore Courts but has also acted as counsel in international arbitrations, both ad hoc and institutional, including LCIA, ICC, SIAC, KCAB, GAFTA, FOSFA, LMAA and SCMA arbitrations.

Priscilla Lua is a Partner in the firm’s Litigation & Dispute Resolution Practice.

Priscilla specialises in international arbitration and commercial litigation. She has an active practice spanning a number of areas including projects & infrastructure, construction, oil & gas, shareholder (and company law) disputes, joint venture disputes, and employment.

Priscilla acts as counsel in court and international arbitration proceedings and has experience with various institutional rules such as ICC, SIAC, LCIA, HKIAC, UNCITRAL as well as ad-hoc arbitrations. She has also been appointed by the SIAC as a sole arbitrator.

Her practice frequently involves complex cross-border elements, and she acts for multinational companies in the construction, power, oil & gas sectors, as well as for banks and financial institutions.

Prior to joining the firm, Priscilla practised for six years with an elite UK magic circle firm in both its Singapore and London offices. Whilst with the magic circle firm, she also spent close to a year in Hong Kong with a client on an international secondment and was widely praised by the client for being “commercially focussed in her drafting which was of a very good quality” and for being “always astute and practical in her approach”. Prior to her joining the magic circle firm, Priscilla spent a number of years with a pre-eminent Senior Counsel in one of the Big Four domestic law practices in Singapore.

As a result of her broad international experience, Priscilla is able to grasp complex cross-border disputes quickly and prides herself on providing effective and practical solutions to clients.

Levin has assisted counsels appearing at all levels of the Singapore Supreme Court and has appeared as counsel before the Singapore State Courts. She has also assisted clients in multi-party mediations involving complex issues.

Apart from commercial work, Levin takes on CLAS matters as well. Levin is a SIMI-Accredited Mediator and was also appointed as a Young IP Mediator by the Intellectual Property Office of Singapore in 2020.
