Description

About the Event

This short course will focus on admiralty judgments handed down or reported in the last year. It will examine recent developments in admiralty law, practice, and jurisdiction, focusing on recent decisions from the courts of Singapore, Malaysia, England and Wales, Australia, and Canada.

Issues that will be highlighted include stays of actions and security (The Sea Justice), forum non conveniens (The Scot Stuttgart), the boundaries of the admiralty jurisdiction (The Inuksuk I, The Merlion), the definition of a ship (The Eco Spark), salvage (the UKSC on Argentum Exploration), inherent jurisdiction to renew writs (The Bao Lai), insolvency and admiralty (The Setia Budi), sanctions and wrongful arrest (The Alpine Mathilde), Himalaya clauses (The Dijksgracht), and judicial sale (The Yangtze Fortune).

Some of the more significant cases will be considered in detail; others will be highlighted but not discussed in so much detail. Care will be taken to illustrate how these new cases develop, resolve, or raise further questions on the development of the law in this field.
