Description

ABOUT THE SEMINAR

The decarbonisation of ships poses severe commercial challenges to the sector. In addition to the inherently difficult and costly enterprise to adopt sustainable fuels and design more efficient ships, the adoption of several regulations targeting energy efficiency and market-based mechanisms challenge the way shipping contracts are performed and make the compliance of the ships to such regulations reliant upon the cooperation between shipowners, charterers and cargo interests. The seminar will examine the established regulatory provisions and review contractual efforts to develop cooperative approaches. The potential for legal disputes in the efforts to redistribute the costs of decarbonisation for the various market-based mechanisms will be assessed. The protracted regulatory process adopted by the IMO suggests that, until clean fuels become the norm, contractual arrangements will need to be continuously amended to deal with the gradual transition to sustainable shipping.
