ABOUT THE SEMINAR

This seminar will select some recent court cases on (1) the general principles of insurance law that apply to both marine and non-marine insurance and (2) the meaning of several coverage-related terms – mostly in the liability insurance context. In category (1), we will cover insurable interest in marine cargo insurance, proof of physical loss as opposed to pure economic loss, proof of what caused the loss and whether two causes brought about the loss interdependently, insurance brokers’ failure to exercise reasonable skill and care towards their clients and the clients’ contributory negligence, co-insurance and subrogation. In category 2, we will focus on the interpretation of a maritime construction project, the meaning of some insured and excluded risks, and estoppel by convention. The seminar will end by considering the aggregation of COVID-19-related business interruption losses and the “follow the settlements” clause in reinsurance.

ABOUT THE SPEAKER

Özlem Gürses is Professor of Commercial Law at King’s College London. She specialises in insurance and reinsurance law. Özlem is the author of Marine Insurance Law 3rd edn (Routledge, 2023), The Law of Compulsory Motor Vehicle Insurance (Informa, 2019) and Reinsuring Clauses (Informa, 2010). She has edited the Edward Elgar Research Handbook on Marine Insurance Law (2024). Özlem sits on the British Insurance Law Association (BILA) Committee and the Presidential Council of the International Insurance Law Association (AIDA). She Chairs AIDA’s Reinsurance Working Party. Özlem teaches insurance and reinsurance law at King’s College London and abroad and presents her research at national and international conferences.
