ABOUT THE SEMINAR

There are bills of lading and there are ship’s delivery orders. What exactly is a ship’s delivery order, does it matter which law applies to that question, and how does a ship’s delivery order relate to a bill of lading? The speaker will give a general introduction on the subject, outline the system of the UK Carriage of Goods by Sea 1992 c 50/Singapore Bills of Lading Act 1992 (2020 rev ed) and address these questions above. The speaker will also revisit the UK Court of Appeal judgment in Glencore International AG v MSC Mediterranean Shipping Co SA [2017] EWCA Civ 365, in which the ship’s delivery order played a pivotal role. The session will end, as always, with Q&A.

ABOUT THE SPEAKER

Dr Michiel Spanjaart is an advocate with Trains & Co and an advisor to Kneppelhout in Rotterdam. His practice areas include trade, transport, and insurance. He is a deputy judge with the Court of Appeal in Amsterdam and an Academic Fellow of the Centre for Maritime Law (CML) at NUS Law. Michiel teaches maritime law at the Erasmus University in Rotterdam, and is teaching Carriage of Goods by Sea at NUS this academic year. He obtained his LLB at the University of Utrecht in 1996 and his PhD at the Erasmus University in 2012. His thesis, Vorderingsrechten uit cognossement (‘Rights of suit under a bill of lading’), was published by Paris Uitgeverij in 2012. His book Multimodal Transport Law was published by Routledge in 2018. His latest book, The Straight Bill of Lading, was published by Routledge in 2024.
