CML Insurance (including marine) and Reinsurance Updates 2024
2024 was a blockbuster year in terms of the number of insurance-related cases decided by the English courts. CML was glad to have Visiting Professor Özlem Gürses (Professor of Commercial Law, King’s College London) deliver a concise and clear update on a substantial body of case law. An appreciative crowd attended her presentation on ‘CML Insurance (including marine) and Reinsurance Updates: 2024’ on 16 January 2025. Among them were practitioners from the local bar specialising in maritime law. They heard Professor Gürses discuss 19 cases. These included the ‘Win Win’ case of Delos Shipholding SA v Allianz Global Corporate and Specialty SE [2024] EWHC 719 (Comm); [2024] 1 Lloyd’s Rep 489, Mok Petro Energy FZC v Argo (No 604) Ltd [2024] EWHC 1935 (Comm), and Royal & Sun Alliance Insurance plc v Textainer Group Holdings Ltd [2024] EWCA Civ 547. Professor Gürses used the abundant case law to touch upon a broad range of topics, including conditions precedent, warranties, contractual interpretation, pay-to-be-paid clauses, aggregation, the meaning of ‘occurrence’, causation, damages for late payment under the Insurance Act 2015 (UK).
