Professor Stephen Girvin gives seminar on ‘Seaworthiness and Passage Planning’ at Kincaid | Mendes Vianna Advogados

May 14, 2026 | Faculty, In the News

During his recent visit to Brazil, Professor Stephen Girvin spoke at the Rio de Janeiro offices of the leading law firm, Kincaid | Mendes Vianna Advogados (https://www.kincaid.com.br/), which celebrated its 90th anniversary in 2022, on 14 May 2026.

Stephen spoke at the invitation of Lucas Leite Marques (Partner) and Marcos Fontes Ferreira (Lawyer), and with the assistance of Paulo Henrique Reis de Oliveira (Lawyer), under the firm’s ‘Corporate University’ initiative. He gave a presentation on ‘Seaworthiness and Passage Planning’, highlighting in particular, two English cases, Alize 1954 v Allianz Elementar Versicherungs AG (The CMA CGM Libra) [2020] UKSC 51, [2021] Bus LR 1678, [2021] 2 Lloyd’s Rep 613, CMI1619, in which an inaccurate passage plan was held to be causative of the vessel’s unseaworthiness, and Unity Ship Group SA v Euroins Insurance JSC (The Happy Aras) [2026] EWHC 7 (Admlty), [2026] 1 Lloyd’s Rep 151, CMI2757, in which a ‘basic’ passage plan was not causative, but the vessel was unseaworthy owing to the master’s incompetence.

CML and Professor Girvin would like to extend our thanks to the folks at Kincaid | Mendes Vianna Advogados in Rio de Janeiro – and especially Lucas Leite Marques, Marcos Fontes and Paulo Henrique Reis de Oliveira – for their wonderful hospitality and for kindly hosting the seminar on ‘Seaworthiness and Passage Planning’.
