The Appropriate Forum for Collision Actions
Collision claims are amongst the claims in which jurisdictional rules play a pivotal role. Parties will seldom agree on a forum to resolve their inter-ship dispute, and the existence of parallel proceedings in collision claims is by no means unusual for various reasons, not least the significant disparity in the tonnage limitation regimes in force across various maritime jurisdictions.
This research will compare the conflict of laws rules for collision claims and the arguments presented by the courts in granting or refusing to grant a stay of proceedings, aims to design a list of objective criteria for determining the appropriate forum to be applied by the courts precluding prolonged and costly parallel proceedings and increasing certainty.
