| The regulatory regime for ESG in India is at a nascent stage. At present, ESG reporting and disclosures by companies leave much to be desired. Internationally, many countries have started adopting the ESG regime however there is a lack of international standards for ESG disclosures and ESG ratings. In India, the Business Responsibility and Sustainability Report (BRSR) framework of the Securities Exchange Board of India (SEBI) attempts to improve the ESG regime by offering a standardised reporting format and leading to greater transparency in the market. This growth of ESG in India is furthered by initiatives by various Ministries. The Ministry of Corporate Affairs in this respect has taken the first step by developing guidelines and SEBI has formulated the BRSR framework. Also, ministries like the Finance Ministry have analysed this trend of impact investing and aim to utilize it for making the economy greener. The current research aims to explore the legal regime for ESG in India and whether it is sufficient to address the socio-legal challenges India is facing. It will also delve into the role of directors of a company in adequate implementation of ESG regime. Are such duties enforceable under the law? What is ESG investing? How does it impact the Indian stock market? Lastly the research will also examine the connection between BRSR and ESG reporting and in the light of this connection, how the role of the Securities and Exchange Board of India can be examined. |
