Description

This short course is designed to give participants a concise introduction to Singapore’s competition law framework. Participants will be given an overview of the three main statutory prohibitions against anti-competitive conduct (anti-competitive agreements, abuse of dominance and mergers which substantially lessen competition) found in the Competition Act 2004. The course will pay attention to the core underlying legal and economic principles behind the competition law system, with references made to the caselaw from the infringement decisions and guidelines of the Competition Commission of Singapore (CCCS), as well as the appellate decisions of the Competition Appeals Board (CAB).
Recent decisions of the CCCS, including the Supply of Live Poultry cartel and the Grab-Uber merger, both of which attracted some of the largest fines ever imposed by the Singapore competition authority, will be discussed to illustrate the key legal and economic principles introduced in this course.

Target Audience
This course is designed for legal practitioners, corporate counsel, civil service officers and other interested persons with a basic understanding of Singapore’s legal system. Some familiarity with micro-economics would be helpful but not essential.

(a) Overview of Singapore’s competition law system – the regulator, the legal framework, objectives and goals, fundamental economic principles
(b) Anti-competitive Agreements – hard core cartelistic conduct, other prohibited forms of collective behavior
(c) Abuse of Dominance – Establishing market power, Market Foreclosure, Commitments
(d) Merger Control – Assessing the impact of mergers on competition, Remedies imposed by the CCCS
