ABSTRACT
In the landmark decision of Orchroid Trading v Chua Siok Lui [2018], the Singapore Court of Appeal set out the legal framework governing the illegality defence in contractual and restitutionary claims. In particular, the decision examines the principles governing the recovery of payments made under illegal contracts. This seminar will walk participants through the nuances of the decision, highlighting the legal issues which the SGCA has settled as well as the fresh questions that it raises and which require further attention.

About The Speaker
Dr Burton Ong is an Associate Professor at the National University of Singapore and convenor of the Contract Law module, which is part of the NUS Law School’s first-year core curriculum. Burton teaches and researches in Contract, Competition and IP Law. He was one of the general editors of the first volume of the Studies in the Contract Laws of Asia monograph series published by Oxford University Press. Dr Sandra Booysen is an Associate Professor at the National University of Singapore and deputy-director of the Centre for Banking and Finance Law. Sandra teaches and researches in Contract and Banking Law and serves on the editorial boards of two journals, the Singapore Journal of Legal Studies and International Banking and Securities Law.
