Description

The increasing use of evidence that involves the use of computer systems and algorithms to gather and process information raises issues not only about the admissibility of AI-generated electronic evidence, but also about the limitations inherent in machine learning. How should the law deal with questions such as the proof of the reliability of AI systems, such as automated vehicle identification records and facial recognition in security recordings? Will the law of hearsay operate to exclude AI-generated evidence, including credit reports? Can deepfakes ever be disproved in a court of law? And how should parties and the courts address considerations relating to the discovery of evidence generated by AI systems, like automated transcripts?

The speakers will propose that a carefully calibrated application of the laws of evidence can address many of these issues, but suggest that it is just as important for the bar and the bench to be adequately informed about the proper analysis of the issues.

This seminar is based on an article published in the 2021 Singapore Academy of Law Journal Special Issue on
Law and Technology.
