Description

The law of marine insurance in England has undergone dramatic change in the past few months. The Insurance Act 2015 has entirely recast the law on pre‐contractual presentation of the risk, on the enforcement of warranties and other conditions, on fraudulent claims and on damages for late payment. There are also new cut‐through rules which will have an important effect on direct claims by cargo‐owners against P&I Clubs. All of this is of great importance to Singapore: the law is for the first time out of line with that in England; many policies written for Singapore policyholders are governed by English law; and Singapore insurers reinsuring into London will do so under English law. In addition to the legislative changes, there has been a series of crucial decisions in England on matters ranging from fraudulent claims to the meaning of constructive total loss. This seminar will provide an overview of the all of these developments and indicate their significance for Singapore.

About The Speaker

Professor Robert Merkin QC is one of the leading authorities on marine insurance law worldwide. He is Lloyd’s Professor in Commercial Law at the University of Exeter and Special Counsel to DLA Piper. Professor Merkin has published extensively and is a consultant to the English and Scottish Law Commissions for their project on insurance contract law reform. He is one of the writers of Arnould’s Law of Marine Insurance and Average 18th ed (2013), the leading work on marine insurance law and has written numerous books on insurance and reinsurance law in England, Australia, Hong Kong and New Zealand. Professor Merkin is Vice‐President of the International Association of Insurance Law (AIDA) and Secretary of the AIDA Reinsurance Working Party. He co‐edits Lloyd’s Law Reports and sits on the arbitral panels of the Singapore International Arbitration Centre and the Hong Kong International Arbitration Centre.
