Abstract:

This article deals with force majeure clauses and the strict character of a seller’s duty and a voyage charterer’s duty to supply a cargo. It considers also alternative modes of performance, where a performing party has an option in the matter, as well as the liability in damages of a party in breach claiming that its breach has been overtaken by a later event of a frustrating character.
