ABOUT THE SEMINAR

The seminar will consider recent cases and developments in the trade finance area in England and Wales, Singapore and other common law jurisdictions. The aim of the seminar is to consider developments in Singapore itself, as well as foreign developments that might be instructive to Singaporean courts, academics and practitioners. The seminar will likely cover recent cases in England, Singapore and elsewhere dealing with SWIFT messages and forgery; the impact of sanctions upon letters of credit and the effectiveness of sanctions clauses; the incorporation of letter of credit terms and the status of the UCP 600; assignment and set-off in relation to letters of credit; and the impact of fraud, forgery and sham transactions upon the payment and reimbursement obligations under the letter of credit. Time permitting, the seminar will also examine recent market-based and legislative initiatives in Singapore and abroad to address the impact of fraud and technology on trade finance transactions.

ABOUT THE SPEAKER

Christopher Hare is the Travers Smith Associate Professor of Corporate and Commercial Law at the University of Oxford and a Tutorial Fellow in Law at Somerville College, Oxford. After studying at Cambridge, Harvard and Oxford, Christopher practised for a short period at the English Bar and has recently returned to practice, representing the (unsuccessful) respondent in Barclays Bank plc v Philipp (UKSC, 2023). He has previously held teaching posts at the University of Auckland and Jesus College, Cambridge, with teaching and research interests broadly in the law of obligations and the corporate and commercial law fields, but with a particular focus on domestic and international banking law, corporate finance, and shareholder remedies. His books include Ellinger, Lomnicka and Hare, Modern Banking Law (OUP, 5th ed, 2011); Cranston, Avgouleas, Van Zwieten, Hare and Van Sante, Principles of Banking Law (OUP, 3rd ed, 2018); Davies, Worthington and Hare, Gower’s Principles of Company Law (Sweet & Maxwell, 11th ed, 2021); Hare and Ooi, Trusts Law in Singapore (LexisNexis, 2021); Watts, Campbell and Hare, Company Law in New Zealand (LexisNexis, 3rd ed, 2023). He has also contributed chapters on syndicated lending and tiers of lenders to Paget’s Law of Banking (LexisNexis, 15th ed, 2023), as well as editing (with Dora Neo), Trade Finance for the 21st Century (Oxford University Press, 2021).
