CBFL Symposium: Developments in Secured Transactions Law in Brunei Darussalam, Malaysia and Singapore

Dora Neo (NUS Law), Khairon Niza Md Akhir (Companies Commission of Malaysia) and Pengiran Nina Jasmine binti PLKDR Pg Haji Bahrin (Brunei Darussalam) presented at the symposium on “Developments in Secured Transactions Law in Brunei Darussalam, Malaysia and Singapore” on 26 January 2024, with the Centre for Banking & Finance Law. The session was commentated by Orkun Akseli (University of Manchester).

The symposium discussed legislation governing secured transactions, as the law relating to personal property security is increasingly receiving the attention of legislators worldwide as a means towards financial inclusion and economic growth.

Discussing specifically on the laws in Brunei Darussalam, Malaysia and Singapore, the speakers examine the secured transactions law in these countries. Despite these three neighbouring countries having close economic ties and sharing a common legal tradition based on the law of England, secured transactions law in each of these countries is at a different stage of development. The speakers elaborated and compared the current legislation on secured transaction in their respective countries and discussed the potential for future reform. With each of the speakers sharing their expertise in this area and bringing perspectives from their own experiences, participants were able to have a comprehensive view on the law of secured transactions in these countries and had a meaningful discussion on the potential reforms in this area
