[Journal Article] ‘The Community Interest in the Cape Town Convention’ by Jack Wright Nelson

‘The Community Interest in the Cape Town Convention’ has been published in the Cape Town Convention Journal, vol. 9 (1) 2024.  The Cape Town Convention is viewed as a private law convention, with one of its principal objectives being to insulate creditors’ and lessors’ interests in aircraft objects from the often-turbulent finances that characterize the international civil aviation industry. The article argues that the Cape Town Convention reflects what international legal theory calls a ‘community interest’ – specifically, the community interest in the creation of global markets. Jack Wright Nelson is a CBFL Associate Academic Fellow and the Editor of the Annals of Air and Space Law (McGill University).
