In the seminar “Liberal Political Authority and Private Right” held on 17 September 2024 by the Centre for Legal Theory (CLT), Dr Arie Rosen discusses what is valuable in the general part of contract law, with its depoliticized and decontextualized conceptualization of the stakes of contractual relations. He responds to two theoretical approaches that are used to justify the narrow normative focus of this part of the law. He rejects both approaches, instead offering a theory of the role of liberal political authority in delineating private right. These approaches were extensively discussed during the seminar.
