Overview

This course will provide an overview of the key principles in commercial conflict of laws from the perspective of the law in Singapore. The course seeks to introduce the participants to the following key issues: (i) the principles based on which courts in Singapore decide whether to entertain international commercial disputes; (ii) interlocutory measures issued by courts in Singapore in the context of international commercial litigation; (iii) the different regimes according to which courts in Singapore give effect to foreign commercial judgments; and (iv) the provisions based on which Singapore courts determine the law governing the parties’ cross-border commercial disputes.

Learning Objectives

This course aims to equip participants with

1. the relevant skills to identify and evaluate some of the most significant conflict-of-laws issues arising in commercial disputes containing cross-border elements;
2. an understanding of the principles which Singapore courts apply in responding to these issues; and,
3. an awareness of some of the key considerations which are important to those who are engaged in international commercial transactions.

Pre-requisites

Bachelor’s degree in Law & relevant legal work experience.

Assessment

2-hour Online Test

The online assessment will consist of 10 short-answer questions, requiring responses that are no more than 200 words in length. The questions seek to test the participants’ understanding and application of the core concepts and principles of commercial conflict of laws from the perspective of the law in Singapore. The weightage or marks may vary for each question. Participants must obtain a minimum test score of 50% to pass.

Proof of Attendance

Upon successful completion of the course & obtaining a minimum of 75% attendance, every participant will receive a Certificate of Completion issued by NUS Law Academy.

Trainer’s Bio

Dr Ardavan Arzandeh joined NUS Law in 2021. He is an alumnus of the University of Bristol, where he read law as an undergraduate (LLB: 2006), postgraduate (LLM: 2008) and doctoral student (PhD: 2011). Ardavan has received Lord Hardwicke and Lord Denning Scholarships from Lincoln’s Inn, and was called to the Bar of England and Wales (Lincoln’s Inn) in July 2012.

Ardavan’s principal research expertise is in commercial conflict of laws. He is interested in exploring various questions arising in this area from doctrinal, historical, and comparative perspectives. He is the author of Forum (Non) Conveniens in England: Past, Present, and Future. This is the first book-length study devoted entirely to examining the forum (non) conveniens doctrine’s past, present, and future from the perspective of the law in England. Additionally, Ardavan has published articles in leading generalist and specialist law journals, including the Law Quarterly Review, Legal Studies, International & Comparative Law Quarterly, Lloyd’s Maritime and Commercial Law Quarterly, and the Journal of Private International Law. Ardavan’s work has been cited by the UK Supreme Court (Villiers v Villiers [2020] UKSC 30, and Enka v Chubb [2020] UKSC 38), the US Court of Appeals for the 6th Circuit (Prevent USA Corp v Volkswagen AG, 17 F.4th 653 (6th Cir. 2021)), and the High Court of Hong Kong (Fong Chak Kwan v Ascentic Ltd [2020] HKCFI 1889).

Between 2012 and 2020, Ardavan was employed as Lecturer and Senior Lecturer in Law at the University of Bristol.
