Description

Civil law is the most widespread legal tradition in the world, and Asia, to which the civil law came by colonisation or modernisation, is no exception. By focusing on the shared principles of civil law jurisdictions and contrasting them with common law principles, this course aims to introduce common law-trained professionals to the ways in which their civil law-trained counterparts approach legal issues and find solutions.

This three-part course discusses the differences between the civil and common legal traditions, the origins of the civil law and the reasons for its spread to Asia. It uses hypotheticals to explain the techniques the civil law applies for resolving legal problems and thereby refers to the civil codes of civil law jurisdictions such as Germany, Japan, South Korea, Taiwan and the People’s Republic of China. The hypotheticals draw on areas of the law that best represent the civil law way of thinking: the coming into existence and enforcement of contractual obligations, the law of delict, property and unjustified enrichment. It also introduces concepts unknown in the common law world such as negotiorum gestio and culpa in contrahendo. At the end of the course, participants will be better prepared for discussions with their civil law counterparts and find it easier to gather information from and about civil law jurisdictions.

Participants may choose to attend individual modules, but the purposes of the course are best achieved if participants attend all three modules.
