Description

Maritime law in the PRC is not always easily accessible to students and practitioners of law trained in the common law tradition. There areseveral challenges. First, the matter of learning about a particular genus of civil law. Secondly, the issue of understanding the PRC system of law and legal institutions, more generally. Thirdly, there is the language difficulty; even for those who are conversant in Chinese, as the language of the law is not always easily understood. Last but not least, the juxtaposition of international norms and PRC domestic law in the maritime context raises questions of conflict and comparability.

This seminar will explain the basic PRC legal system and scheme of maritime law governance in the PRC. The main areas covered include the scope of application of PRC Maritime law; the liability of carrier, crew and shipper; transport documents; charterparties; ‘wet’ shipping (collision, salvage, towage, general average); and marine insurance. We shall compare these aspects of PRC law with the provisions and principles in English law and international conventions. No prior knowledge of PRC law or the Chinese language is required.

About The Speaker

Professor Jason Chuah is Head of Department and Professor of Commercial and Maritime Law at the City Law School, City University London and Visiting Research Professor at the Centre for Maritime Law at NUS. He was the holder of the Cambridge Commonwealth Trust Award, Barclays Bank Scholarship and the Cambridge Commonwealth Fellowship at Cambridge University. He also has a Professional Certificate in Export with Distinction from the UK Institute of Export. He was nominated twice as the OUP Best Law Teacher of the Year in the UK.

He has published well over 200 articles and is the author of nine books, including the highly respected, Law of International Trade 5 th edn (Sweet & Maxwell), the co-authored Encyclopaedia of Banking Law ((Butterworths) with Sir Peter Cresswell, Sir William Blair, Philip Wood, Richard Hooley, George Walker etc.) and Cases and Materials on the Carriage of Goods by Sea” (4th edn (Routledge)(with A. Rogers & M. Dockray) . He has also contributed to J. Hjalmarsson & J. Zhang (eds), Maritime Law in China (Routledge, 2016). He is editor of the Journal of International Maritime Law, International Company and Commercial Law Review, International Trade Law and Regulation, Shipping & Trade Law, International Transport Law Review, and Finance & Credit Law. His work has been cited in the UK, US, EU and Asia. He is also Executive Director of the London Universities Maritime Law and Policy Group. He has been involved in various consultations with the UK Ministry of Justice, the OECD, the ICC, the Association of British Insurers, the UNCITRAL, etc.
