The English courts have recently discussed and shed further light upon some major issues of insurance law including constructive total loss and notice of abandonment, (Sveriges Angfartygs Assurans Forening (The Swedish Club) v Connect Shipping Inc [2018] EWCA Civ 230), insurers’ right of subrogation against a party co-assured (Haberdashers’ Aske’s Federation Trust Ltd v Lakehouse Contracts Ltd [2018] EWHC 558 (TCC)), interpretation of true warranties and suspensory conditions in property insurance (Bluebon Ltd v Ageas (UK) Ltd (Formerly Fortis Insurance Ltd) [2017] EWHC 3301 (Comm), interpretation of aggregation clauses in the context of policy limits (Spire Healthcare Ltd v Royal & Sun Alliance Insurance Plc [2018] EWCA Civ 317), and claims made policies: notification of circumstances which might give rise to a claim and recovering mitigation costs in professional indemnity insurance (Euro Pools Plc (in Administration) v Royal and Sun Alliance Insurance Plc [2018] EWHC 46 (Comm). This talk will not only cover the facts and ratios of these cases but also explain the underlying principles. It will also look at how the law has developed and discuss the contribution of these cases to the current law.

About The Speaker

Özlem Gürses has a law degree and an LLM from the University of Istanbul and LLM (Maritime Law), with distinction, and PhD degrees from the University of Southampton. Özlem formerly worked as a Lecturer at the University of East Anglia and as a Senior Lecturer at the University of Southampton. She is currently Reader in Insurance and Commercial Law at the Dickson Poon School of Law, King’s College London, where she teaches insurance and reinsurance law to undergraduate and post-graduate students. Her interests include maritime and insurance law and she is author, among other things, of The Insurance of Commercial Risks: Law and Practice 5 th ed (Sweet and Maxwell, 2016), Marine Insurance Law 2 nd ed (Routledge, 2016), and Reinsuring Clauses (Informa, 2010), her doctoral thesis. Özlem is a member of the Presidential Council, Marine Insurance and the Reinsurance Working Parties of the International Insurance Law Association/Association Internationale de Droit des Assurances (AIDA).
