Description

Many disputes arising out of contracts are about what the contract means. This, often difficult, question has provoked many cases but until recently was not much discussed in the books. The last fifteen years has seen a major change. Three excellent books have appeared (two English and one Australian) and there have been a number of very important decisions in the House of Lords/UK Supreme Court.
The lectures will consider what the current position is and highlight the most important changes. It will also consider another important and closely related question. Sometimes one of the parties seeks to argue that the written contract does not accurately reflect the agreement and sometimes the court will grant the remedy of Rectification to correct the error. Recent cases leave the scope of this remedy not wholly clear.
