Description

The seminar will explore the German concept of Rechtsstaat (Rule of Law). The speaker therewith aims to contribute to the comparative studies of Civil Law and Common Law by introducing this important principle deriving from the German jurisprudence and later transplanted into a number of civil law jurisdictions in Asia.

To this end the speaker will present the historical background and varying aspects of the Rechtsstaat. Additionally, the speaker will compare the purpose of this concept with those of the principle of democracy and of human rights, and explain the conditions under which the Rechtsstaat was successfully established and consolidated in Germany.

About The Speaker

Prof. Dr. Birgit Daiber, LL.M.Eur. is a German lawyer specialized in German Constitutional Law, EU Law and the European Convention on Human Rights with a special interest in Constitutional History. Additionally to working in academia in Germany she has gained practical experience in her field at the German Federal Constitutional Court, the European Court of Justice, the German Federal Parliament and the European Department of the German Federal Ministry of Economy and Technology. In 2013 she was appointed as Assistant Professor at the Seoul National University (SNU) School of Law, which promoted her to Associate Professor in 2017.
