Description

The UK Supreme Court’s two Brexit judgments read well, and provide a narrative exposition to the UK constitution. They provide clarifications of principles, competencies, rights and procedures. In Professor Mads Andenas’ view, they are exciting developments in that the court steps into the breach where the executive and legislature have failed, not without precedent but further than the textbook explanations would make you expect.

You find the most recent Supreme Court judgment available on the Supreme Court home page, UKSC [2019] UKSC 41 R On the application of Miller) (Appellant) v The Prime Minister (Respondent), Cherry and others (Respondents) v Advocate General for Scotland (Appellant) (Scotland): https://www.supremecourt.uk/cases/uksc-2019-0193.html

You may also benefit from watching the judgment summary by the President, Lady Hale, https://www.supremecourt.uk/watch/uksc-2019-0193/judgment.html, who also has explained the context in a speech available on the Supreme Court home page: https://www.supremecourt.uk/docs/speech-191008.pdf

The Benn Act is important, and note the text of the letter about extension which is taken into the statutory text, The European Union (Withdrawal) (No. 2) Act 2019, http://www.legislation.gov.uk/ukpga/2019/26/enacted/data.htm
