Description

This course will look at recent developments in the law of marine insurance taking account of decisions from the courts of England, Australia, Canada, Hong Kong and Singapore. Issues which have arisen for decision include General Average with a case unusually requiring a ruling from the UK Supreme Court on the York-Antwerp Rules overturning a longstanding misunderstanding by practitioners and leading commentators. Other issues to be covered are insurable interest, non-disclosure, misrepresentation, the perils of the seas, theft, piracy, person acting maliciously and Cargo All Risks as well as cases dealing with Sue & Labour and Constructive Total Losses. Definitive ground-breaking judgments of the UK Supreme Court on fraudulent claims and illegality of contracts will be discussed.

There will be a review of the market’s reaction to the English Insurance Act 2015 in the form of new P&I Club Rules and LMA Clauses. The long awaited Third Parties (Rights against Insurers) Act 2010 which entered into force in 2016 will also be considered.

About The Speaker

Dr Steven Hazelwood was a partner in a leading City of London shipping and insurance law firm, serving in their London, Hong Kong and Singapore offices where he was Senior Resident Partner. Specialising in complex insurance and marine casualties, he has handled cases in the highest courts such as the Court of Appeal and House of Lords and international arbitrations in London and New York. He has taught law at various universities, in England and around the world, and has been an examiner to the Bar Council of England and Wales and to the Institute of Chartered Shipbrokers. A former Consultant to the Shipping Division of the United Nations Conference on Trade and Development (UNCTAD) in Geneva, he has also spoken at numerous international conferences and seminars. He has published many articles on shipping law and marine insurance. Dr Hazelwood is the author of P & I Clubs: Law & Practice 3rd Edition (LLP, 2000) and one of the general editors of Marsden and Gault’s Collisions at Sea 14th Edition (Sweet & Maxwell, 2016).
