About the Seminar

The attention on shipyards, as regards the sustainability agenda, has focused mainly on the shipyard’s health and safety duties and its liability for environmental damage. However, in the light of IMO 2020 and ballast water management challenges to the industry and indeed, also the widespread imposition of ESG standards to corporates, shipyards now are having to ensure sound sustainability practices in ship building, design, fitting and retro-fitting. This seminar interrogates how well sustainability imperatives might be facilitated by contractual and financial devices. It will also consider how and to what extent back to back arrangements with participants in the longer (and global) supply chain should be structured, managed and legally facilitated.

In conclusion, it examines whether “green” implied terms might be developed to fill in gaps in a spirit consistent with ESG standards.

About the Speaker

Professor Jason Chuah PhD FRSA SFHEA is Professor of Commercial and Maritime Law at The City Law School, City University of London. He was a holder of three scholarships at the University of Cambridge and a Certificate in Export with Distinction from the Institute of Export. He chairs the influential London Universities Maritime Law and Policy Group. He has been involved in various consultations with the UK Government (most recently on the trade finance gap and the sacking of seafarers by P&O Ferries), the UN (advising on the UN Sustainable Shipping Guidance 2020), the EU, the ICC, the Association of British Insurers, the UNCITRAL, etc. He has published twelve books and over 200 journal articles. His works have been cited in the EU, US, UK and Asia.
