About the Webinar
In this webinar, we discuss a number of important cases and evolving remedial doctrines in Singapore contract law, including: i) the relationship between expectation and reliance measures; ii) the availability of an account of profits as a remedy for breach of contract; iii) cost of cure damages and the relevance of intention to cure; iv) Wrotham Park damages; and v) the regulation of liquidated damages via the penalties doctrine. Decisions discussed include: Liu Shu Ming and anor v Koh Chew Chee and anor [2023] SGHC(A) 15; JSD Corp Pte Ltd v Tri-Line Express Pte Ltd [2022] SGHC 227; Phua Seng Hua and ors v Kwee Seng Chio Peter and anor [2022] SGHC(A) 11; Ethoz Capital Ltd v Im8ex Pte Ltd and ors [2023] SGCA 3. Broader themes and trajectories relating to the law of damages are also touched on, such as the importance of proper pleading and proof, obstacles to non-compensatory or exceptional measures in Singapore law, and the courts’ appreciation of commercially sensible solutions in contractual disputes.
About the Speaker
A graduate of NUS (LL.B.) and Harvard Law School (LL.M. and S.J.D.), Dr. Tan Zhong Xing presently teaches contract law and legal theory at NUS Law. He is a member of the Leadership Team at NUS Law and Director of the Sheridan Fellowship Programme. Zhong Xing’s research and teaching interests are in contract law, private law and legal theory, and commercial and corporate law more generally. His work has been published in a number of leading general and specialist law journals in the common law world, and has been cited by the Singapore Court of Appeal.
Over the last few years, Zhong Xing has been the recipient of various awards for research and teaching, including the Hart Publishing Prize for the best paper by an early career scholar at the Ninth Biennial Conference on the Law of Obligations, and previously, Harvard Law School’s Project on the Foundations of Private Law Prize. He has also been awarded the NUS Faculty Annual Teaching Excellence Award on multiple occasions as well as the NUS University-Level Annual Teaching Excellence Award.
