Abstract:

The Penal Code of Bhutan 2004 is the main repository of the general principles of criminal responsibility in Bhutan. A significant number of these general principles are concerned with criminal defences, which accused persons can rely on in answer to a criminal charge. Co-authored with JSW Law’s Dema Lham and published by Kuensel in Bhutan, this book discusses all the major defences contained in the Penal Code.

This book is intended to serve as the forerunner to a larger, comprehensive work covering all the general principles of criminal responsibility, together with the major offences in the Penal Code. Three foreign criminal law experts will join the current authors to form a team to write this larger volume, which is expected to commence in mid-2021.
