Abstract: This chapter explores the Supreme Court decision in Regency Villas Ltd v Diamond Resorts (Europe) Ltd in which the apex court opined on a long-standing, and disputed issue going to the scope of the law of easements; holding that purely recreational and sporting rights could amount to valid easements. The chapter reflects on what was, at the time, and still remains so important about the decision and examines the (ongoing) significance of the judgment for the law of easements and the role of the Supreme Court more generally.
