Review Essay: Negotiating the Antinomies of the Singapore Constitutional Order
Citation: [2009] Sing JLS 661The curious case of the Singapore constitutional order continues to confound political and legal theorists alike. On paper, the constitutional framework appears straight- forward enough. There is a written Constitution. The Constitution provides that it is the “supreme law of the Republic of Singapore”, and that any law enacted after its commencement which is inconsistent with the Constitution “shall, to the extent of the inconsistency, be void”. Part IV of the Constitution, entitled “Fundamental Liberties”, may be approximated to a written bill of rights. Finally, the Constitution provides for the familiar three branches of government—the executive, the legislature and the judiciary—after the normal understanding of the theory of separation of powers. - Case and Legislation Notes
