Description

About the Event

Crude oil and products are regularly traded through simple exchanges of short emails. Such ‘confirmation notes’ are then processed by specialist in-house teams and a to and fro of requests for amends usually follows. Very rarely do the parties finally agree on each and every single technical amendment; this notwithstanding, performance follows, and most deals are a success. The notion that the parties may not have a full and detailed agreement in place while dealing with such expensive and dangerous shipments would be very unwelcome to any oil trader. In BP Oil International Limited v Glencore Energy UK Limited [2022] EWHC 499 (Comm), however, the Commercial Court found certainty in the most unlikely of places. Two years later, what was the impact of BP Oil v Glencore on oil trading practice? Why should we all worry?
