Although resulting trusts have attracted a lively discussion in case law and in the literature, fundamental disagreements still exist concerning their justification, practical application, and role within the law of trusts. In this seminar, I will discuss a number of points I am seeking to address in my next monograph, Rationalising Resulting Trusts (Hart Publishing). These include: what do resulting trusts respond to; what are the duties of a resulting trustee; what is the relationship between resulting trusts and unjust enrichment; why do resulting trusts arise; and what is the role of resulting trusts
within the law of trusts as a whole?
