NUS Law welcomes our Visiting Faculty for Semester Two of the academic year.

Gary Born (Advanced Issues in the Law and Practice of International Arbitration)
Visiting Professor

Professor Gary Born is the chair of the International Arbitration Practice Group at WilmerHale. He is widely regarded as the world’s preeminent authority on international commercial arbitration and international litigation. He has been ranked for the past 20 years as one of the world’s leading international arbitration practitioners and the leading arbitration practitioner in London.

Gary has participated in more than 600 international arbitrations, including four of the largest ICC arbitrations and several of the most significant ad hoc arbitrations in recent history. Mr. Born is uniformly ranked by Euromoney, Chambers, Legal500 and Global Counsel as one of the leading practitioners in the field. He is one of only two lawyers in the world, and the only lawyer in London, to receive global “starred” status in Chambers rankings for international arbitration.

He heads the firm’s 70-person international arbitration group, which is based in London and integrated with related practices in our New York, Washington, Berlin and Brussels offices. He has represented European, US, Asian and other companies in arbitrations under all leading institutional rules (ICC, LCIA, AAA, Vienna, Stockholm, ICSID) and in ad hoc arbitrations in all leading international seats (London, Paris, Geneva/Zurich, Vienna, Stockholm, New York, Washington, Singapore). He also sits as arbitrator (presiding arbitrator, sole arbitrator and co-arbitrator). He has served as arbitrator in more than 175 institutional and ad hoc arbitrations.

Paul Czarnota (Sports Law)
Visiting Senior Fellow

Paul Czarnota practises as a Barrister of the Victorian Bar, Australia. He is also admitted as an Attorney to the New York State Bar. As a Barrister, he maintains a broad and varied common law, commercial litigation and arbitration practice, with a particular focus on torts (personal injury and insurance) and sports law.

He regularly advises and appears for athletes and sports governing bodies in sports-related disputes including anti-doping, match-fixing, and disciplinary matters. He regularly sits on sporting tribunals and arbitration panels that are convened to hear disciplinary matters, and was a former board member of BMX Victoria. He is also a Senior Fellow of the Faculties of Law of both the University of Melbourne and Monash University, where he teaches Sports Law units in their respective LL.M. programmes.

Paul has Bachelor of Commerce and Bachelor of Laws (with Honours) degrees from Monash University, and a Master of Laws degree from the University of Melbourne, where he specialised in sports law. He is widely published on various sports law issues.

Franco Ferrari (Conflict of Law in International Commercial Arbitration)
Visiting Professor

Professor Franco Ferrari is a Professor of Law and Director of Center for Transnational Litigation, Arbitration and Commercial Law at the NYU School of Law. He was most recently a Chaired Professor of International Law at Verona University in Italy. Previously, he was a Chaired Professor of Comparative Law at Tilburg University in the Netherlands and the University of Bologna in Italy.

Professor Franco Ferrari has taught classes on the Private International Law, International Civil Litigation, International Commercial Sales, International Commercial Arbitration, Law of Obligations, Comparative Legal Systems, Comparative Law of Torts, Comparative Law of Contracts, Comparative Private Law, Uniform Law, International Business Transactions, and Forum Shopping.

Peter Jaszi (Fair Use in Theory and Practice)
Yong Shook Lin Professor in IP

Peter Jaszi is an Emeritus Professor at American University Washington College of Law who writes and lectures about copyright law in historical and cultural contexts. An American, he was a founder of the Glushko-Samuelson Intellectual Property Law Clinic and the Program on Intellectual Property and Information Justice.

Having served as a Trustee of the Copyright Society of the U.S.A., Professor Jaszi remains a member of its journal editorial board. Since 2005, he has been working with Professor Patricia Aufderheide to help creative communities develop fair use guidance documents that reflect their particular problems and practices. In 2007, he received the American Library Association’s L. Ray Patterson Copyright Award. A second edition of his book (with Patricia Aufderheide), Reclaiming Fair Use (2011) will be published next year by the University of Chicago Press.

Douglas Kysar (Climate Change Law & Policy)
Lionel A. Sheridan Visiting Professor

Professor Douglas Kysar is Joseph M. Field ’55 Professor of Law at Yale Law School. His teaching and research areas include torts, environmental law, climate change, products liability, and risk regulation. He received his B.A. summa cum laude from Indiana University in 1995 and his J.D. magna cum laude from Harvard Law School in 1998.

He has published articles on a wide array of environmental law and tort law topics, and is co-author of two leading casebooks, The Torts Process (9th ed. 2017) and Products Liability: Problems and Process (8th ed. 2016). Professor Kysar’s monograph, Regulating from Nowhere: Environmental Law and the Search for Objectivity (YUP 2010), seeks to reinvigorate environmental law and policy by offering novel theoretical insights on cost-benefit analysis, the precautionary principle, and sustainable development.

Kate Lewins (International Carriage of Passengers by Sea)
Visiting Professor

Professor Kate Lewins is a Professor at the Murdoch University School of Law. She graduated from the University of Western Australia (B.Juris 1987, LL.B 1988) and practised in shipping and insurance law before joining academia. Kate holds a Master of Laws degree from University of Southampton, UK and a Ph.D. from Murdoch University.

Kate has taught courses in contract, torts, legal writing, civil procedure, shipping law, insurance and admiralty law. She has written numerous peer-reviewed papers on admiralty, maritime, insurance and related topics, including carriage of goods by sea, crimes on board ships at sea, the effect of the Trade Practices Act /Australian Consumer Law on contracts for the carriage of goods, contracts for the carriage of cruise ship passengers, and bailment.

She is the author of the monograph International Carriage of Passengers by Sea (Sweet & Maxwell, 2016), the first work to tackle this important and growing area of maritime law. She is a past general editor of the Australian and New Zealand Maritime Law Journal and is the Director of the International Maritime Law Arbitration Moot.

Jonathan Lim (Advanced Issues in the Law and Practice of International Arbitration)
Visiting Senior Fellow

Jonathan Lim is a Senior Associate with Wilmer Cutler Pickering Hale and Dorr (WilmerHale) in London. His practice focuses on complex international disputes. He has represented governments and private corporations in commercial and investment arbitrations under all major arbitration rules in common law and civil law jurisdictions across Africa, Asia, Europe and South America. He has also advised governments in Africa and Asia on a range of public international law issues and the drafting of arbitration legislation. In addition to his practice as counsel, Jonathan also has a developing practice as an arbitrator and has been appointed as sole and party-appointed arbitrator in proceedings seated in Europe and Asia.

Jonathan is co-chair of the Asia-Pacific Forum on International Arbitration, and serves on the YSIAC Committee, the SIAC Users Council (UK), and the CIArb Young Members Group Committee (London and SE). He is also a member of the New York Convention Task Force for the Federal Government of Somalia, and a member of the Task Force formed by the Intergovernmental Authority on Development to establish an East African arbitration center in Djibouti.

He is listed in the Who’s Who Legal 2018 as a Future Leader in International Arbitration (a list of leading under-45 practitioners from around the world), and has been described as “a very smart all-round lawyer with a strong work ethic,” “able to digest and master a large amount of material very quickly,” and “always available to provide creative and practical solutions.”

Peter L. Strauss (Administrative Justice: Perspectives from the U.S)
Visiting Professor

Professor Peter L. Strauss is the Betts Professor of Law Emeritus at Columbia Law School. He teaches courses in administrative law, legal methods, and legislation. He joined the faculty in 1971, and has served as vice dean twice.

One of the most influential American scholars of administrative law, Professor Strauss has prepared important teaching materials and written widely on the subject. His views and analysis are well captured in Administrative Justice in the United States, (3rd ed. 2016, Caroline Academic Press).

He received his LL.B. from Yale Law School in 1964 and his A.B. from Harvard College in 1961. Before joining the Law School, he clerked for David L. Bazelon and William J. Brennan in Washington, D.C. He also spent two years lecturing on criminal law in the national university of Ethiopia, and three years as an attorney in the Office of the Solicitor General, briefing and arguing cases before the U.S. Supreme Court. From 1975 to 1977, he was on leave from Columbia as the first general counsel of the United States Nuclear Regulatory Commission.
